Intellectual Property & Copyright
Copyright has become an issue on so many levels now. Who owns
it, who can use it, who infringed on it? Our opinion on Copyright
is that it has been over used and misused. Copyright is for the
protection of a person or companies' intellectual property and
should not be abused. Why do we mention this? Because many companies
similar to ours will use Copyright as a tool to put leverage on
your and extract more fees for work you have already paid for!
At Archiform 3D we aim to be the easiest company to deal with.
We may enforce copyright where we are protecting your interests,
our own interests or our right to be paid for the job.
Who owns the copyright of the work we produce? We do. Once you
have paid your bill you will have the right to use the work as
often and as long as you need and at absolutely
no extra cost for
purposes that don't conflict with out Terms
and Conditions. This is an important point as many companies
will charge you an additional fee if you want to use the work in
certain circumstances. An important point is that some of our work,
particularly video productions, may have licensing issues for voice
overs and talent that could restrict geographical regions that
they are broadcast in - please check before you decide to air productions
or TV commercials in areas outside of where they were originally
designated as the license for the use of talent and voices may
need to be extended. The extension of a license would require additional
fees paid to the artist or talent. Archiform 3D deliberately promotes
the use of open licenses and prefers to use artists and talent
that comply with this, meaning one fee covers everything, but
sometimes this is not possible.
If you don't pay us for the work we have done
then we do not allow any right to use the work, which we consider
as very fair. If you only pay for part of the project then we still
don't release the use. If you hold back funds on the last payment
then we still wont allow use.
We will not allow any other client to use your artwork unless
you specifically ask us to do so or give approval and this must
be in writing. Your images will not appear on any project that
you haven't allowed them to, at least while within our control.
You can expect that we will display the work we do for you in
our gallery of images or within other portfolios for the purpose
of displaying our ability and experience. We permanently retain
the right to do this.
